조건부 영주권자 (Conditional Resident) 카드 만료 4년 연장

이민국 (USCIS)은 1월 23일, 규정에 따라 기한 내에 조건부 해제신청 (Remove Conditions)을 한 조건부 영주권자 (Conditional Resident)의 카드 기간을 48개월 자동 연장해준다고 발표했다.

 

가족이민의 경우 배우자 영주권 케이스 중 영주권 승인 시점에 결혼한지 2년이 안된 경우 2년 만료 조건부 영주권 카드 (Conditional Resident Card)를 발급한다. 조건부 영주권자는 2년 만료 90일 전부터 만료일 전에 공동명의 서류 (Joint Documents) 등을 제출해 진실된 결혼 (Bona Fide Marriage)을 증명해야 10년 만료 정식 영주권 (Permanent Resident) 신분을 부여한다.

 

취업이민의 경우 투자이민 (EB-5)에서는 2년 만료 조건부 영주권 카드를 발급해주며, 2년간의 유예기간을 두고 이민국이 요구하는 자격요건 (USCIS Requirements) 을 충족했음을 증명해야 10년 정식 영주권을 부여한다. 투자이민 역시 2년 만료 90일 전부터 만료 전에 조건부 해제신청을 할 수 있으며, 이민국 요구 자격요건 즉, 투자금 총액, 영리 사업체 설립, 10명 이상 Full Time 신규고용 창출 등을 증명해야 한다.

 

조건부 해제신청 (Remove Conditions)은 이민국 신청서 Form I-751 (가족이민) 또는 Form I-829 (투자이민)를 사용해 신청할 수 있으며, 규정을 준수하여 접수된 케이스에 한해 접수증 (Receipt Notice)에 기존 조건부 영주권 카드 만료일로부터 48개월 자동으로 영주권 신분을 연장 (Extention) 해주는 증명을 기재해준다. 이 접수증 원본 (Orginal Notice)과 기존의 만료 (Expired)된 조건부 영주권 카드를 함께 지참하면 해외여행이 가능하고, 미국내에서 취업할 수 있는 신분임을 증명할 수 있다.

 

Form I-751 (가족이민)을 접수하는 케이스는 2023년 1월 25일 부터 적용되며, Form I-829 (투자이민) 케이스는 2023년 1월 11월 부터 적용해 48개월 자동연장 접수증을 발급한다. 또한 이미 이 신청서들을 접수해 24개월 자동 연장을 받고 해제신청 수속이 진행중 (Pending)인 케이스들의 경우 조건부 영주권 카드 만료일로부터 48개월까지 자동 연장해주는 새로운 접수증을 발급해준다.

 

연장기간을 늘려주는 방침은 신청인들의 불편함을 해소해준다는 점에선 환영할만한 일이지만 그 만큼 이민국에서 케이스가 지연되고 있으며 앞으로 심사시간이 더 소요될 수 있다는 반증이라고 할 수 있겠다.

USCIS Extends Green Card Validity for Conditional Permanent Residents with a Pending Form I-751 or Form I-829

USCIS is extending the validity of Permanent Resident Cards (also known as Green Cards) for petitioners who properly file Form I-751, Petition to Remove Conditions on Residence, or Form I-829, Petition by Investor to Remove Conditions on Permanent Resident Status for 48 months beyond the card’s expiration date. This change started on January 11, 2023, for Form I-829 and will start on January 25, 2023, for Form I-751.

We are making this change to accommodate current processing times for Form I-751 and Form I-829, which have increased over the past year.

USCIS has updated the language on Form I-751 and Form I-829 receipt notices to extend the validity of a Green Card for 48 months for individuals with a newly filed Form I-751 or Form I-829. We will issue new receipt notices to eligible conditional permanent residents who previously received notices with an extension shorter than 48 months and whose cases are still pending. These receipt notices can be presented with an expired Green Card as evidence of continued status, while the case remains pending with USCIS. By presenting your updated receipt notice with your expired Green Card, you remain authorized to work and travel for 48 months from the expiration date on the front of your expired Green Card.

As a reminder, conditional permanent residents who plan to be outside of the United States for a year or more should apply for a reentry permit by filing Form I-131, Application for Travel Document, before leaving the United States.
